CASABANA reserves the right to make any modifications it deems necessary to these General Terms without prior notice. These modifications may be communicated through its websites and will take effect from the time they are published, remaining valid until superseded by new terms. However, CASABANA may choose to apply certain Special Terms of Contracting in specific cases, giving due notice as appropriate.

The website's purpose is Marketing of clothing and accessories.

The contract's duration will be linked to delivery of the product, without prejudice to the right of withdrawal.

As a user or customer, you expressly declare that you understand and accept these terms of use and the general terms of contracting. Furthermore, you confirm that you are of legal age and possess the necessary legal capacity to access CASABANA's websites and enter into contracts through them.

You can register as a user on the website to facilitate online purchasing in the designated area. In accordance with current data protection legislation, CASABANA will inform you that the personal data collected during registration and subsequent purchases will be processed in accordance with CASABANA's processing system for managing your interactions and any subsequent actions.

Your data will be kept for the time strictly necessary to fulfill the above purpose, unless other storage periods are legally required.

During the purchase process, you should identify yourself with your user name and password. These data will not be made public. You are responsible for treating confidentially and responsibly the identity and password acquired during registration as a customer and you may not disclose them to other users. You can change the information registered on the website at any time, in your customer area. In this same section, you will have access to a history of your orders. This is only a consultation section. However, certain procedures are allowed, such as deleting those records that you no longer consider necessary to view.

Upon completing the purchase process, you will receive a confirmation email. You must provide a valid email address during the purchasing process. If you do not receive confirmation within 24 hours after placing your order, please contact CASABANA at info@casabana.com.

All of the website's contents is in English, Spanish, Portuguese, Italian and Deutch.

When you receive the product at the delivery address you have given, it will also include an invoice or a copy of the order.

Basic features of the products

The products offered in our online store include a photograph and the products' basic features, which is the information provided by the manufacturer. The product's colour, as shown in the photograph, is not binding. The product's colour is identified in its features.

Warranties

All products available on the website are covered by the supplier's sales warranty. CASABANA offers after-sale services that customers can utilize during the warranty period by contacting CASABANA's establishment, the after-sales department via email at info@casabana.com, or through the designated points established by the supplier.

Prices

All products display the selling price in Dollars and include Sales Added Tax.

Should any other tax apply, this will also be indicated (for example, IGIC or IPSI).

Delivery and carriage costs

CASABANA only ships to the United States and Venezuela for the moment.

Forms of payment

You can pay for your order in any of the following ways. You must indicate which one you choose during the purchase process:

- VISA or MASTERCARD credit card

All operations that involve the transmission of personal or financial data are conducted within a secure environment on a server utilizing standard security technology SSL (Secure Sockets Layer). All information sent is encrypted during transit through the web.

Additionally, your credit card details are directly entered on the bank's website, at the bank's POS (Point of Sale Terminal), and are not recorded on any CASABANA server.

When paying via VISA or MASTERCARD, you will be prompted for your card number, expiry date, and a Validation Code (the last three digits printed in italics on the back of your card) to enhance transaction security.

This payment method is valid exclusively on the website.

In cases of fraudulent or improper charges levied against a payment card number, the cardholder may request immediate cancellation of the charge. Subsequently, the relevant debit and credit entries in the accounts will be processed as soon as possible.

However, if the purchase was legitimately made by the cardholder, and the refund request was not a result of exercising the right of withdrawal, the cardholder will be liable for damages incurred due to the cancellation.

Any exchange fees and bank charges are to be paid by the customer. - Direct debit

The availability of products offered by CASABANA may vary based on customer demand. Although CASABANA regularly updates its inventory, the requested product may occasionally be out of stock. If a product cannot be supplied due to unavailability, CASABANA will notify the customer via email as soon as possible, but in no case will the notification exceed 30 days. CASABANA may offer two options: sourcing a product with similar or higher quality for the same price, or, barring justified reasons, refunding the sums paid for the canceled order within the same timeframe.

Returns

Customers must return or deliver products directly to CASABANA within a maximum period of thirty calendar days from the date of purchase. The return period is considered fulfilled if the customer returns the product prior to the expiry of this period.

The customer will bear the costs of the return.

Refund of payment

Refunds will be issued using the same payment method employed by the customer, unless stated otherwise.

CASABANA will process refunds within 30 calendar days from the date the right of withdrawal is received.

Return of faulty products

If the product is defective for reasons not attributable to the customer, the customer is entitled to return the product, notifying CASABANA of the return reason using any contact method outlined in these terms. Returns for faulty or damaged products will not be considered an exercise of the right of withdrawal. 

CASABANA commits to cover the return costs and to replace the product with a new one in accordance with the terms accepted at the time of sale.

Jurisdiction

Additionally, CASABANA reserves the right to take any civil or criminal actions deemed necessary for the misuse of its website and content or for non-compliance with these terms.

The relationship between the user and the provider will be governed by current applicable regulations in United States of America. In the event of a disagreement, parties may submit their conflicts to arbitration or to the ordinary courts under applicable jurisdiction rules. CASABANA is located in Miami, Florida, USA.

Applicable law and jurisdiction

This Legal Notice is governed by United States of America law. Therefore, any disputes regarding the interpretation of the terms and conditions contained herein and any matters related to the products and services offered on the website will be resolved according to applicable Spanish legislation.

In the event of any disputes arising from the use of the services provided on this website, the parties, expressly waiving any other jurisdiction to which they may otherwise be entitled, agree to submit to the law courts of the user’s domicile, provided it is situated within United States territory.
